Terms of Use

1. Description of the service

AGENTOVA.AI is a SaaS platform operated by PILBEE GmbH, allowing entrepreneurs and professionals to delegate certain tasks to specialized intelligent virtual agents.

Each agent (including Charlotte, Arthur, Margot, Amandine, Ethan, Benoît, Samy, etc.) is designed to perform specific functions such as: content creation, sales prospecting, customer service, marketing, organization or data analysis.

The service relies in particular on:

• a simple and intuitive conversational interface;
• an intelligent onboarding system;
• automated actions on the user’s connected tools, under the user’s control.

2. Access to the platform

Access to the platform is reserved for:

• individuals of legal age;
• with an active user account;
• who have subscribed to a valid plan.

The user agrees to provide accurate, complete and up-to-date information when registering, and to keep it accurate throughout the use of the service.

3. Use of consumables

3.1 Use of the agents

The agents offered on AGENTOVA.AI are the exclusive property of PILBEE GmbH.

The user is free to interact with the agents in the normal course of using the service, but is prohibited in particular from:

• reproducing, copying, extracting or attempting to reconstruct their operating logic;
• reselling, sublicensing or transferring access to the agents to third parties;
• transferring or integrating the agents on another platform without written authorization.

Data provided by the user (texts, prompts, files, content) remains the user’s property and can be exported on request, within the technical limits of the platform.

3.2 Credit system and consumption

Use of the agents on AGENTOVA.AI is based on a credit system:

• 2 credits = 1 request including the generation or analysis of an image

Credits are allocated according to the subscription plan. Users can check their available credit balance directly from their dashboard.

If credits run out, access to the agents will be temporarily suspended until the account is topped up or the subscription is renewed.

4. User responsibility

The user is solely responsible for:

• the configuration of the agents;
• the data they submit;
• the actions performed through their agents and connected tools.

Any abusive or misused use, or use contrary to these Terms of Use (account sharing, deliberate overload, fraudulent or unlawful use), may result in suspension or closure of the account, without notice or compensation.

5. Limitation of liability

AGENTOVA.AI is provided as is, with no guarantee of continuous availability or of freedom from errors.

PILBEE GmbH cannot be held liable in particular for:

• temporary service interruptions;
• malfunctions caused by incorrect, incomplete or poorly configured data supplied by the user;
• decisions made or actions taken by the user on the basis of responses or automations generated by the agents.

The agents do not constitute personalized legal, financial or professional advice.

6. Customer support

Support is available to users:

• by email: [email protected] (indicative response time: 48 to 72 business hours);
• through a chatbot built into the platform (automated answers powered by artificial intelligence).

7. Account suspension or deletion

PILBEE GmbH reserves the right to suspend or delete a user account in the event of:

• failure to comply with these Terms of Use;
• fraudulent or non-compliant use of the service;
• excessive or abusive consumption not suited to the subscription taken.

The user may claim no compensation in these cases.

8. Personal data

Personal data is processed in accordance with:

• the General Data Protection Regulation (GDPR – EU 2016/679);
• the Swiss Federal Act on Data Protection (nFADP).

9. Intellectual property

All elements making up the AGENTOVA.AI platform (interface, design, structure, agent names, logos, technologies, content, prompts and architectures) are protected by intellectual property law and remain the exclusive property of PILBEE GmbH.

Any unauthorized reproduction or use is strictly prohibited.

10. Governing law and jurisdiction

These Terms of Use are governed by Swiss law.

In the event of a dispute, the parties will endeavor to reach an amicable solution.
Failing that, the dispute will be subject to the exclusive jurisdiction of the courts of the canton of Zug (Switzerland).

11. Compliance with Google API rules

AGENTOVA.AI undertakes to comply with the Google API Services User Data Policy, including the Limited Use requirements.

Data from Google services (including Gmail or Google Workspace) is used only to provide the features explicitly requested by the user, with their consent, and is not misused or shared with unauthorized third parties.
